Bip&Drive, S.A., with registered address at C/ Serrano 45, Planta 2, Local A, 28001 Madrid (Spain), with tax code A-86969607 and phone number +34 911 113 737 (hereinafter, "Bip&Drive" or the "Company"), is the data controller responsible for the processing of personal data which is provided via the website www.bipdrive.com and the app. This clause provides information on the use that the Company will make of your personal data.

In addition, this Privacy Policy is intended to provide information about the rights that apply both to customers and potential customers under the General Data Protection Regulation ("GDPR"). This privacy policy includes tables identifying each of the different services provided by Bip&Drive.

These tables will give you information about:

  • The purposes of processing your personal data, i.e. the reason why Bip&Drive processes your personal data.
  • The lawful bases which allow the Company to process the data for each of the indicated purposes.
  • The possible disclosure of your data to third parties, as well as the grounds for said disclosure. Please note that we do not transfer your personal data to third parties unless there is a legal obligation (tax agency, judges and courts, security forces, Spanish Organisation of Consumers and Users) or it is explicitly indicated in the tables below. However, your data may be accessed by Bip&Drive data processors, i.e. the service providers which have to access your personal data to perform certain tasks. The service providers which may access your personal data mainly work in the information systems and technology industries. The tables below show any other industries in which Bip&Drive service providers have to access your personal data.
    You may request more detailed information about the recipients of your data by sending an email to privacidad@bipdrive.com, indicating the specific process about which you would like information with regard to recipients or safeguards.

  • The retention period of the data which you provide us with. Please note that we retain your personal data for the duration of the contractual relationship or for a longer period if you have given us consent to do so. Your data will subsequently remain restricted for the exercise or defence of judicial, administrative or fiscal claims for the restriction periods of the legal actions determined by regulations in force.

All fields marked with an asterisk (*) in the forms provided must be completed. Failure to do so may render it impossible to send messages or process the purchase required to provide you with the requested services.

To ensure that the information provided is always up-to-date and does not contain errors, please promptly inform Bip&Drive of any modifications and rectifications to your personal data by sending an email to privacidad@bipdrive.com.

Similarly, when you click on the "Send/Continue" button included in the aforementioned forms, you are declaring that the information and data provided is accurate and truthful.



4. Exercising your rights


You may exercise the following rights:

  1. right of access to your personal data to see which data is being used and the processing operations carried out with your data;

  3. right to the erasure of your personal data, when possible.
  4. right to request restriction of processing your personal data, when the accuracy, lawfulness or necessity of the use of data is questionable, in which case, we may retain the restricted data for the exercise or defence of claims.

The Company shall no longer process your data unless there is an overriding legitimate interest or for the establishment, exercise or defence of legal claims.

You may exercise your rights at any time and free of charge as follows:

  1. By sending an email to privacidad@bipdrive.com indicating the right you wish to exercise and your personal details.
  2. In addition, we will include a link to unsubscribe from commercial messages at the bottom of all messages that we send you, which will allow you to unsubscribe from all previously accepted commercial messages.

Meanwhile, you have the right to lodge a complaint to the Spanish Data Protection Agency if you believe that we have breached data protection regulations on the processing of your personal data.



5. Detailed information on service-specific processing.


If you are our customer:

  2. When you have requested the service for your vehicle inspection test via our app, in which case your data shall be transferred to this entity to handle your request.
The categories of service providers which may access your data, in addition to those mentioned in section 2 are commercial service providers, electronic mailing services, call centres and customer service entities, invoicing services and legal consultants.
In exceptional circumstances, if you use your Vía-T in France, our local Vía-T provider shall have access to your data.
International data transfers shall not be made on the basis of this processing. During the contractual relationship.

To send commercial messages about products of other Group companies in order to offer their services for the transport, insurance and automotive industries. Consent: By ticking the corresponding box, you give your consent for Bip&Drive to send commercial messages from third parties. Your personal data shall not be transferred on the basis of this processing.
The categories of service providers which may access your data, in addition to those mentioned in section 2 are providers of digital marketing services or mailing/tracking services, call centres and call recording services.
International data transfers shall not be made on the basis of this processing. Up to 3 months from the last interaction with the Company once the contractual relationship has ended.
To transfer your data to Saba Infraestructuras, S.A. and Abertis Autopistas España, S.A. in order to send you commercial messages. Consent: By ticking the corresponding box, you give your consent for the transfer of your data in order to send commercial messages. Your personal data shall be transferred to Saba Infraestructuras, S.A. and Abertis Autopistas España, S.A.
The categories of service providers which may access your data coincide with those mentioned in section 2.
International data transfers shall not be made on the basis of this processing. During the contractual relationship.
To analyse solvency and risk (to assess your solvency and risk prior to contracting the services). Legitimate interest of Bip&Drive: The Company has a legitimate interest in guaranteeing your solvency and your level of risk as a customer prior to contracting the services. International data transfers shall not be made on the basis of this processing. Until the enquiry has been resolved.
To send messages in order to offer you Bip&Drive services. Legitimate interest of Bip&Drive: to keep you informed about your products and services. Your personal data shall not be transferred on the basis of this processing.

The categories of service providers which may access your data, in addition to those mentioned in section 2 are providers of digital marketing services or mailing/tracking services, call centres and call recording services.

6. Security


Bip&Drive has implemented and upholds the security levels required by the GDPR to protect the personal data of potential customers against accidental losses and unconsented access, processing or disclosure, taking into account the state of the technology, the nature of the data stored and the risks to which it is exposed. However, the transfer of information over the Internet is not entirely secure. Therefore, and despite the fact that Bip&Drive makes every effort to protect the data of potential customers, it cannot guarantee the security of this data when it is being transferred to the website and the app. Therefore, all the information you provide shall be sent at your own risk. Once your data has been received, Bip&Drive shall use stringent security procedures and functions to prevent any unconsented access.



7. Confidentiality


The personal data which we may collect via the website, the app or over the phone shall be processed with confidentiality and we undertake to keep it secret in accordance with the provisions of the applicable legislation.



8. Minors


Children under 18 may not use the services available via the website and the app without prior consent from their parents, guardians or legal representatives, who shall be solely responsible for all acts performed via the website and the app by minors under their care, including filling out forms with the personal data of said minors and ticking the relevant boxes, where applicable. In this regard, and to the extent that Bip&Drive is unable to check whether users are minors, please note that parents and guardians must set up the necessary mechanisms to prevent minors from accessing the website or app and/or providing personal data via the enquiry form without their supervision. Bip&Drive does not accept any responsibility in this sense.



9. Updates to the privacy policy


This Privacy Policy may have to be updated, so you should check it regularly and, if possible, whenever you access the website or the app in order to keep abreast of the type of data collected and its processing. You may find the Privacy Policy in the footer of the website and the app. Notwithstanding the above, we shall let you know about any modification to this privacy policy which may affect the processing of your personal data.

This Privacy Policy is effective from 1 June 2018.
